Quotes

  • All quotes supplied by Small Business Internet Solutions (SBIS) are valid for 1 month unless otherwise stated. A quote will be taken to be accepted upon SBIS’s receipt of a signed quote along with a nonrefundable deposit representing one half of the total quote value

Payment Terms

  • 1. SBIS requires an amount equal to one half of the total quote value to be paid in accordance with clause 5 prior to the commencement of work.
  • 2. Following completion of any work SBIS requires full payment of the invoice within seven (7) days. SBIS reserves the right to withhold any completed work from the client until the receipt of full payment
  • 3. Should SBIS be unable to complete the web site within 30 days of the client acceptance of the quote, SBIS will invoice the client for any work completed to that date. The client agrees to pay this amount within 7 days of the invoice date.
  • 4. Accounts that remain unpaid 14 days after the invoice due date will forfeit all free web site submissions included in the quote without further notice being provided to the client..
  • 5. Payments will be made by cash, cheque or direct bank deposit as agreed between the parties.

Cancellations

  • 1. Any cancellation by the client will result in the forfeiture of the nonrefundable deposit.

Web Site Content

  • 1. Clients are required to ensure that the content of their web site meets all the current Australian Publishing Legislation. It is the responsibility of the client to ensure that the standards imposed by any legislation are met on an ongoing basis.
  • 2. SBIS reserves the right not to include any material supplied by the client if SBIS deems it inappropriate or offensive.

Permissions and Copyrights

  • 1. The client will obtain all the necessary permissions and authorities in respect of the use of all copy, graphics, registered company logos, names and trademarks or any other material supplied by the client.
  • 2. Supply of above mentioned material by the client shall be regarded as a guarantee by the client to SBIS that all such permissions and authorities have been obtained.
  • 3. The client irrevocably and unconditionally indemnifies SBIS against any loss, cost, liability and damage suffered or incurred by SBIS as a result of;
  • a) The client failing to comply with the terms of this agreement
     
  • b) Any claim by any person relating to or arising from the client’s breach or infringement of any trademark or copyright right of another party.
  • 4. Any intellectual property supplied to the client by SBIS including graphics, text and logos remain the property of SBIS.  The client will have the first option to license any such intellectual property from SBIS on any terms that SBIS, in its complete discretion, thinks fit.

Errors and Liabilities

  • 1.SBIS does not accept any responsibility for losses or damage arising from errors within any site or if a site is not placed "live" on the Internet.

Web Site Maintenance

  • 1. In the event that the client enters into a web site maintenance contract with SBIS, SBIS will carry out general maintenance of the web site for no more than one and a half hours per month. Hours are not transferable between months and maintenance only includes working on existing material within the site.
  • 2. Any extra work carried out to the site, including the addition of text, pages, photos, graphics, tables, etc., will be charged at an hourly rate.

Alterations

  • 1. SBIS does not accept any responsibility for any alteration to the site performed by another party.
